These Terms and Conditions set out the basis on which Waste Disposal Kingston provides waste collection and related services to domestic and commercial customers. By placing a booking, you agree to be bound by these terms. Please read them carefully before confirming any service.
In these Terms and Conditions, the following expressions shall have the meanings set out below:
Customer means the person, company or organisation requesting the services of Waste Disposal Kingston.
Services means any waste collection, removal, disposal, clearance, recycling or associated services provided by Waste Disposal Kingston.
Waste means any materials, refuse, rubbish, junk, items, goods or other matter presented for collection by the Customer, excluding any prohibited or hazardous materials as defined in these Terms and under applicable waste regulations.
Contract means the agreement between the Customer and Waste Disposal Kingston for the provision of Services in accordance with these Terms and Conditions.
Waste Disposal Kingston provides waste collection and disposal services within its designated service area. The specific nature of the Services, including the type and quantity of Waste to be collected, the collection date and time window, and any additional services, will be agreed at the time of booking.
The Customer is responsible for providing accurate information about the type, volume and location of the Waste. If, on arrival, the Waste differs significantly from the description given at booking, Waste Disposal Kingston reserves the right to adjust the price, amend the Service, or decline to carry out the collection.
Bookings for waste collection may be made by telephone, email, online form, or any other method offered by Waste Disposal Kingston from time to time. A booking is an offer by the Customer to purchase Services in accordance with these Terms.
The Contract is formed when Waste Disposal Kingston confirms acceptance of the booking, which may be communicated verbally, in writing, or electronically. Any quotation provided is an invitation to treat and does not constitute acceptance until expressly confirmed.
The Customer must provide full and accurate details when making a booking, including contact information, collection address, access information, description of Waste, and any relevant time constraints. Waste Disposal Kingston is not responsible for any delay or inability to perform the Services arising from inaccurate or incomplete information provided by the Customer.
Waste Disposal Kingston reserves the right to refuse or cancel any booking at its reasonable discretion, including where the proposed Waste breaches applicable regulations, presents a health and safety risk, or falls outside the scope of Services offered.
Prices for Services will be quoted based on the information supplied by the Customer and the prevailing price structure of Waste Disposal Kingston at the time of booking. Unless otherwise stated, all prices are exclusive of any applicable VAT or other taxes, which will be added at the rate in force at the time of invoicing.
Waste Disposal Kingston may adjust pricing if, upon arrival, it becomes apparent that the volume, type or weight of the Waste differs from the information originally supplied or if additional work is required to complete the collection safely and lawfully. This may include additional charges for difficult access, additional labour, waiting time, or the handling of specific waste types where permitted.
Unless otherwise agreed in writing, payment for Services is due immediately upon completion of the collection or in advance at the time of booking. Waste Disposal Kingston may require a deposit or full pre-payment for certain Services or for new or commercial Customers.
Accepted payment methods will be communicated at the time of booking and may include cash, debit or credit card, bank transfer, or other electronic payment methods. The Customer is responsible for ensuring that payment details are accurate and that sufficient funds are available.
Where credit terms are expressly agreed in writing, invoices shall be payable within the period stated on the invoice. Waste Disposal Kingston reserves the right to charge interest on overdue amounts at the statutory rate and to recover reasonable costs of debt recovery, including legal fees, where applicable.
Failure to make payment in accordance with these Terms may result in suspension or cancellation of Services and may impact any future bookings.
The Customer may cancel or amend a booking by contacting Waste Disposal Kingston using the contact details provided at the time of booking. The following cancellation terms will normally apply, unless otherwise stated in writing:
If the Customer cancels with at least 24 hours notice before the scheduled collection time, any pre-payment may be refunded or applied to a rescheduled booking at the discretion of Waste Disposal Kingston.
If the Customer cancels with less than 24 hours notice, or fails to provide access to the collection point at the agreed time, Waste Disposal Kingston reserves the right to charge a cancellation or call-out fee to cover costs incurred.
Any requested changes to the date, time or scope of the Services are subject to availability and must be agreed by Waste Disposal Kingston. Changes that materially alter the nature or extent of the Services may result in an adjusted price.
Waste Disposal Kingston reserves the right to cancel or reschedule a booking in the event of circumstances beyond its reasonable control, including but not limited to severe weather, road closures, vehicle breakdowns, staff illness, or compliance with legal or regulatory requirements. In such cases, Waste Disposal Kingston will endeavour to notify the Customer as soon as reasonably practicable and arrange an alternative collection time.
The Customer shall:
Ensure that Waste is properly presented, accessible, and ready for collection at the agreed time. This includes bagging or containing smaller items where appropriate and ensuring that items to be collected are clearly separated from items not intended for removal.
Provide safe and reasonable access to the collection location, including any necessary access codes or permissions. The Customer warrants that any access routes and collection areas are safe, free from obstruction, and suitable for the use of collection staff and vehicles.
Ensure that no prohibited or hazardous Waste is presented for collection, unless such Waste has been expressly agreed in writing and will be handled in accordance with applicable regulations.
Comply with any instructions given by Waste Disposal Kingston staff relating to health and safety, access, and proper presentation of Waste.
Waste Disposal Kingston operates in accordance with applicable UK waste regulations and is not authorised to collect certain categories of waste unless specific arrangements are made. Prohibited or restricted items may include, but are not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, fuels, pressurised containers, explosives, radioactive materials, and other hazardous substances.
The Customer must inform Waste Disposal Kingston at the time of booking if they believe any Waste may be hazardous or subject to special handling requirements. If, upon arrival, prohibited or hazardous Waste is identified that was not declared in advance or cannot lawfully be collected under the agreed Service, Waste Disposal Kingston may refuse to collect such items and may charge a call-out or waiting fee.
The Customer shall be responsible for any costs, fines, penalties or losses incurred by Waste Disposal Kingston arising from the Customer's failure to comply with applicable waste regulations or from misdescription of Waste.
Waste Disposal Kingston will handle, transport, recycle and dispose of Waste in accordance with relevant UK legislation, environmental standards, and duty of care obligations. Collected Waste may be sorted, reused, recycled, or sent for energy recovery or disposal at authorised facilities, as appropriate.
Title to the Waste shall pass to Waste Disposal Kingston upon loading onto its vehicle, subject to any applicable laws or specific contractual terms. Once collected, Waste Disposal Kingston has discretion as to the method of treatment and disposal, provided this is lawful and in accordance with environmental and waste management regulations.
Waste Disposal Kingston aims to minimise the volume of Waste sent to landfill, where reasonably practicable, by prioritising recycling and responsible disposal routes within its operational capabilities.
Waste Disposal Kingston will use reasonable care and skill in providing the Services. However, the Company shall not be liable for any loss, damage or expense arising from:
Failure by the Customer to comply with these Terms, including improper presentation of Waste, restricted access, or inclusion of prohibited items.
Events beyond the reasonable control of Waste Disposal Kingston, including but not limited to extreme weather, accidents, traffic conditions, or actions of third parties.
Incidental damage to surfaces, driveways, access routes or property where such damage arises from necessary access or the movement of Waste, and where reasonable care has been exercised. Customers are advised to protect or remove items that may be at risk and to notify Waste Disposal Kingston in advance of any particularly fragile or vulnerable areas.
To the fullest extent permitted by law, Waste Disposal Kingston shall not be liable for any indirect or consequential losses, loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Services or these Terms.
The total liability of Waste Disposal Kingston to the Customer in respect of any claim arising out of the Contract shall not exceed the total price paid or payable by the Customer for the specific Service giving rise to the claim, except where liability cannot be limited under applicable law, including for death or personal injury caused by negligence, fraud, or other liabilities that cannot legally be excluded.
Waste Disposal Kingston maintains appropriate insurance cover in respect of its operations, including public liability insurance, to a level consistent with industry standards. Details of insurance cover can be provided upon reasonable request.
If the Customer has any concerns or complaints regarding the Services, they should contact Waste Disposal Kingston as soon as possible, providing full details of the issue and any supporting information.
Waste Disposal Kingston will endeavour to investigate complaints promptly and, where appropriate, propose a resolution which may include rectification of the Service, a partial refund, or another form of reasonable remedy, depending on the circumstances and in line with these Terms.
Waste Disposal Kingston will collect and process personal data provided by the Customer for the purposes of managing bookings, delivering Services, processing payments, and complying with legal obligations. Personal information will be handled in accordance with applicable data protection legislation in the United Kingdom.
Customer details will not be sold or disclosed to third parties except where necessary to deliver the Services, process payments, comply with the law, or where the Customer has given explicit consent.
Waste Disposal Kingston may amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to the relevant Contract. Updated terms may be made available on request or through the usual communication channels of Waste Disposal Kingston.
If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification or deletion shall not affect the validity and enforceability of the rest of these Terms.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, the Services, or their subject matter.
These Terms and Conditions, together with any written confirmation of booking or specific service agreement, constitute the entire agreement between Waste Disposal Kingston and the Customer in relation to the Services and supersede all prior understandings, representations or arrangements, whether oral or written.
No variation of the Contract shall be effective unless it is in writing and agreed by an authorised representative of Waste Disposal Kingston.
By confirming a booking with Waste Disposal Kingston, the Customer acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
